Unarmed Man Shot At By NYPD Has Been Charged With Assault Because Bullets Hit Bystanders

Glenn Broadnax, a 35-year-old black man from Brooklyn, was unarmed on the night of September 14 when NYPD officers shot at him in the middle of Times Square, striking two bystanders.

 

Instead of apologizing, the New York Times reports that the city has charged Broadnax “with assault, on the theory that he was responsible for bullet wounds suffered by two bystanders.”

Broadnax was emotionally disturbed and dodging cars in the middle of the street when officers say he reached into his pocket to grab what they believed was a weapon, prompting them to open fire. His lawyers says he was reaching for his wallet.

So, because the NYPD is made up of trigger happy, crappy marksmen who fire at unarmed black people with impunity, Broadnax might spend up to 25 years in prison on trumped up assault charges, which the Manhattan district attorney insisted on:

Initially Mr. Broadnax was arrested on misdemeanor charges of menacing, drug possession and resisting arrest. But the Manhattan district attorney’s office persuaded a grand jury to charge Mr. Broadnax with assault, a felony carrying a maximum sentence of 25 years. Specifically, the nine-count indictment unsealed on Wednesday said Mr. Broadnax “recklessly engaged in conduct which created a grave risk of death.”

“The defendant is the one that created the situation that injured innocent bystanders,” said an assistant district attorney, Shannon Lucey.

Meanwhile, the two cops who did the shooting are on desk duty pending an investigation. If the past is any indication, that means they will be back on the streets in no time.

  1. Another part of this outrageous story is that the city of NY is arguing that bystanders injured in this situation, and in others over the last year where NYPD officers shot into crowds, have NO standing to sue the city.

      That’s why they’re charging him and will convict him so they can then say to those people who got shot: “You have no standing to sue.” I guess I just repeated what Debra Sweet said, only in different words. It just goes to show that some very intelligent people who unfortunately are holding public office can be very bad and deceitful; and in the offices they are holding that bad behavior defines bad & false faith and on that legal ground they are not qualified to hold public office.

If whites started this idea, creating a WET before BET, it’s very likely blacks would get angry that they are not recognized on this channel and call it, “segregation”.       It’s responses like this that only promulgate fear and antagonism towards law enforcement. We shouldn’t have to live in fear, but if the late Nelson Mandela taught us anything, it’s that violence only begets violence. This is a despicable act by the city, the cops were wholly in the wrong, but to argue that they deserve death shreds ones self of any credibility. They deserve to be investigated by a non-biased third party (NOT related to the police or the city) and charged dully. Anything other than that is not democracy, it’s lawlessness.

        I’ll take the time to agree with parts of what you said, only to open a few points. Fear and antagonism towards law enforcement isn’t the fault of the people but rather the law enforcers. No one, except law breakers would have to “fear” them if they didn’t utilize that shield as a blocker against the law that they’ve been sworn to uphold. Rather they hide behind it and use it to attack civilians and those who can’t defend themselves. Mandela did teach us about violence begetting more violence, which, in that theory, would be fitting of the original comments about killing them (their violence has begotten more violence – or at least the idea). They deserve to be treated as any other common criminal who took it upon themselves to open fire in an area with people in. Their actions were those of lawlessness, not of democracy. Maybe that’s the problem, too many people trying to uphold a lawless land and are being demonized and attacked by the law makers and enforcers.

        Nelson Mandela cofounded Umkhonto we Sizwe (abbreviated as MK, translated as “Spear of the Nation”) which was the armed wing of the African National Congress (ANC) to fight against the South African government. The Apartheid government was responding with violence to the ANC’s 60 year peaceful struggle to overturn that white supremacist system. Nelson Mandela and the ANC got tired of being killed. I believe that the stalemate which developed whereby the ANC couldn’t verthrow the Apartheid system and the Apartheid system couldn’t defeat the ANC was responsible for the eventual diplomatic/political resolution of the conflict.         Mandella lived in a different era. He will barely be remembered for what he did, as the militarized police take over in that part of the world as they are here.

        I do not promote violence – but if you rmember, neither did the Patriots of 1776. The declaration reads “… but after a long train of abuses…” and then goes on to label those abuses, one of which was not getting legal recourse in the kings courts.

        No people desires to throw off their government, even after tyranncial forces go over the edge. Read the declaration of Independence. Its right there for the world to see.

        I believe that we “havent seen nuthin’ yet.” This is because too many of us sit in our own little world, watching stuff like this happen, and just ignore it because it didnt happen to us. Thats exactly the attitude that prevailed pre-Nazi Germany.

          @Chad. You need to read a few books, and then take a good look around you. A grudge about slavery? How dare black people get upset about 400 years of slavery. That was “decades” ago, right? In fact, they’ve had rights now for, what, 50 years or so? The effects of slavery and institutional racism have clearly been completely eliminated, so black people should just “get over it,” right? They aren’t prosecuted disproportionally, nor do they get disproportionate sentences for similar crimes. The poverty rate among minorities is clearly their own fault, since slavery ended “decades” ago, right? Since Brown v. Board of education, of course everyone has the same educational opportunities. The effects of 400 years of slavery just vanish as soon as a law is passed. A half-century of Jim Crow hasn’t left any lasting effects on the opportunities available to minorities. We should just accept that unarmed black men will continue to get shot, because, well, we’ve come so far.

          One should not complain about what is not have. History must be remembered to live a better now and a great future. If action is not going to be taken, stop the complaining. Blacks have come so far and overcome so much and have so much still to overcome. Many of them still do have a grudge and think forgiving is not on the table. There are so many commenting about the struggles of blacks here, and I am sure there is resentment toward the oppressors. If there is an ounce of resentment in your heart to whites, whatever changes you are trying to accomplish in this society is futile. Resentment builds and becomes hatred, hatred eventually manifests into an action and such action leads to violence. People learn to hate, and since that is so, then they can learn to love…

            i intervened once when 3 blacks were beating and robbing an elderly white man

      With all the calls cops take daily it should be common sense to never reach in your pocket for an ID or anything. Cops think I am strangewhen I alert them of what im going to do for this exact reason. Some people just wanna hurt cops, others dont. If he was resisting thats the worst time to reach in yourpocket. I do not agree with the other charges he got or the monetary part. The cops decided to fire no matter what he did so adding all those other charges on is bad news. I read an article recently about the prison industrial complex and they have contracts that must be ___% full or the state gets hit by the prison (s). So from the get go they have quotas that are passed along to the cops to make them look like jerks. For profit prisons are a bad thing. Of course their stock is traded by many wealthy investors who invest in things on the front end of the prison system too like tue banks considering hsbc and others have been caught laundering theirmoney and we all know they werent doing it as a favor.

Instead of trying to push charges on an unarmed civilian, why not take the guns away from the under qualified officers that should obviously not be carrying the fire arm to begin with.   13. What in the world has this world come to where you can charge someone with a crime they didn’t even commit? Charge him with reckless behavior and test him for drug use, but don’t accuse him of doing something he CLEARLY didn’t do. Trigger happy cops don’t deserve to be cops. Also, law enforcement that likes to put the blame on an innocent man rather than own up to their own mistakes is corrupt and don’t deserve to be serving the people. They need their badges stripped and to have no chance to get back on the force ever again. I wouldn’t want cops like that serving my city.

So the fuck what, you reacted to the situation foolishly, hastily and without reservation. Now you have to face the consequences, if that includes losing your job, your badge and a prison sentence, so be it.

    You took an oath, and then you dishonored it by killing those bystanders, and wrongfully convicting an innocent man due to your stupidity and carelessness.     I was taught as a cop that you look at the area around before you pull the trigger and make sure that innocent bystanders will not get hurt because it is better to let a subject that is not armed and dangerous to get away then fire shots and kill or injure innocent bystanders. Maybe they ought to take a page from the Air Force Security Police Handbook on the use of force and they would’t have to pay so much money because of bad judgement by officers

    First off, learn proper grammar. It would have been “foolish” in the terrible sentence that you just produced. Second, had this been a white man being accused, I highly doubt it would have even made the news at all. Why does everyone out there just assume that anytime a white man and a black man are in a situation that it is automatically racist? Everyone knows that if you flee from the police and then decide to reach into your pocket, that the police will shoot. Those men and women put their lives on the line every day so cowards like you can sit behind a keyboard safe and sound and bash them. The police men had every right to pull the trigger under the circumstances that they were protecting themselves. Yes, it is unfortunate that innocent bystanders were struck but the fact of the matter is that this was not an act of racism. The way trends have been set lately (although completely false), “all white people are racist.” That’s just something I hope people get over in good time. As for the charges, I do believe it is a stretch to charge the man with assault charges. My final point here is that this was not an act of racism. I believe that any police officer, of any race, would have pulled the trigger to protect their own lives. They would have done so based on their life, not the skin color of the suspect.

      The big issue for me is out of hand police officers. Do we really want police officers with the power to shoot at an unarmed person and then claim that they thought the suspect was reaching for a gun? Then the police force, the city and courts all back up the police officers thereby ensuring incidents like this happen again and again. Police officers need to be held accountable when they shoot at an unarmed suspect.

      I gave the issue of Glenn Broadnax being responsible for the shot bystanders to a NYC lawyer. She thought it would be a great question to give to law students. Obviously, it hinges on whether or not the police officers were justified in shooting at Broadnax.

      My lawyer friend thought that the injured bystanders did have standing against the city. Whew! Note that the rise in power of the police parallels the rise in power of the state. It’s one and the same. The police are the state’s henchmen.

    @justsayin …A racist can be of any color and even from the same race. Hate is hate. If the cops were black they deserve the same treatment as their counterparts. There are several issues in this story. First, this idea and acceptance that it’s okay to shoot at an unarmed man (usually of color) without true cause. There is a protocol that is hardly ever followed by tigger happy or scared cops. The other issue here is with the law and the officials who pass them for the sake of covering up their mess. Covering up problems instead of changing them is, shall I say, more problematic. Mind sets and behavior need to CHANGE or we err on the side of evil begets evil. Smh

    EVIDENTLY it is clear that not only whites are racist, it’s quite stupid of that person to even think that, anyways there are levels to the actions meted out towards another due to racism, such as this terrible act these police officers executed. It’s almost 2014, slavery was abolished in most countries by 1838, however discrimination and prejudice towards another race still persists..why??? This post really made me sad to know that such unfair acts like these are still occurring in modern society with our so called “elite judges” who are to be fair enough to anyone in particular: black/white/chinese/etc.. THIS IS NOT THE CASE THOUGH, why?? Racism is created, built and ran by institutions- colleges, courts, government parastatals, religious organizations and corporations. In America most of these institutions are built and ran by whites and white entities to the exclusion and detriment of other races especially the black race. To say that Blacks can be racist is to say that the poor can enforce classism. You and I know they can not because they lack the wherewithal to do that.     A 16 yr old white kid killed four people and seriously injured two people because of underage drunk driving, is put on probation. An unarmed 35 yr old black man is charged with assault because NYPD pulled out their guns and fired at him, hitting two bystanders.
